Does My Nissan Qualify as a Lemon in Los Angeles, CA?

Per the Song-Beverly Consumer Warranty Act (Civil Code § 1793.2), which contains the California lemon law, your Nissan may qualify as a lemon if the manufacturer has been unable to repair a substantial warranty defect after a reasonable number of attempts. California also creates a legal presumption in your favor if, within the first 18 months or 18,000 miles of ownership, any of the following has occurred:

  • A non-safety defect has been the subject of four or more failed repair visits
  • A safety defect has been repaired unsuccessfully at least twice
  • Your vehicle has spent a total of 30 or more days in the shop for warranty-related repairs

Note that the 30 days do not need to be in a row. Further, keep in mind that you can still potentially win your claim even if your vehicle doesn’t meet these specific requirements.

What Types of Compensation Can I Recover in a Nissan Lemon Law Case?

California’s lemon law provides several potential remedies. If your claim is successful, Nissan may be required to offer you a full repurchase of the vehicle, minus a mileage deduction for the time before you first reported the problem. Alternatively, Nissan may be obligated to provide a comparable replacement vehicle. 

In situations where the manufacturer’s failure to act was intentional, you may also recover civil penalties of up to twice your actual damages. These penalties exist to discourage manufacturers from dragging their feet and ignoring legitimate consumer complaints.

How Long Do I Have To File a Nissan Lemon Law Claim in California?

Since Nissan has opted into the new procedures established by Assembly Bill 1755 and Senate Bill 26, specific deadlines now govern your claim. You must file your lawsuit within one year of your vehicle’s express warranty expiring, and no later than six years from the date the vehicle was originally delivered. Also, if you intend to seek civil penalties, you are also required to send Nissan a written pre-suit notice at least 30 days in advance. Mandatory mediation also may be required in some cases.
