California’s Lemon Law: The Song-Beverly Consumer Warranty Act
California’s primary lemon law is the Song-Beverly Consumer Warranty Act, found under California Civil Code § 1790 et seq. This law protects consumers who purchase or lease new vehicles that turn out to have serious defects the manufacturer cannot fix within a reasonable number of repair attempts.
Per the state’s lemon law, if your vehicle has a defect covered by the manufacturer’s warranty and the manufacturer has not been able to repair it after a reasonable number of tries, the manufacturer must either replace the vehicle or buy it back from you. Other cash remedies may be available as well in some cases (more on this below).
The law applies to new vehicles purchased or leased in California that are still under the manufacturer’s original warranty. Certified pre-owned vehicles may also qualify, but only in certain circumstances.
What Qualifies as a “Lemon” in California?
Not every vehicle problem rises to the level of a lemon law claim. Generally speaking, your vehicle may qualify as a lemon if it meets certain conditions:
- The defect is covered under the manufacturer’s warranty
- The issue substantially affects the vehicle’s use, value, or safety
- The manufacturer has had a reasonable number of chances to fix the problem
- The vehicle has been out of service for 30 or more cumulative days for repairs
- The defect was not caused by unauthorized modifications or neglected maintenance
While the law does not set a specific number of repair attempts that qualifies in every case, a common guideline is two or more attempts for a serious safety defect, or four or more attempts for other covered issues.
